Notice was given by publication in The Cape Cod Times, a <br /> newspaper of general circulation in the Town of Mashpee, on February 11 and <br /> February 18, 2002, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 27, 2002, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James E. Regan III, Richard T. <br /> Guerrera and Marshall A. Brem. <br /> � II <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> . . <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> I <br /> The Petitioner's son, Mr. Robert DeVoe, represented the proposal and stated that <br /> plans call for demolition of the existing 16 x 18-foot cottage to allow for construction of a L <br /> single-family home on the subject property. I' <br /> ,I <br /> The Board of Health has approved the proposed installation of a new Title V � <br /> septic system on the property. No Variance relief from the setback or lot coverage <br /> requirements is being requested. <br /> No comments were received from abutters. <br /> i I <br /> SPECIAL PERMIT CRITERIA 1 <br /> § 174-20 of the Zoning By-laws states: <br /> "Rebuilding of destroyed or damaged nonconforming structure. <br /> Any nonconforming building or structure destroyed or damaged by fire, flood lightning, <br /> wind or otherwise may be rebuilt subject to approval of the Board of Appeals subject to <br /> pP J <br /> the same conditions as set forth in § 174-24 of this chapter". <br /> I <br /> III <br />
