Borgeson, Zella E. Elizenberry and Marshall A. Brem. <br /> Ij I <br /> Mr. H. Earl Lantery, Jr. represented the Petitions and stated thatlans call for demolition <br /> P <br /> of the existing summer home, which would be replaced with construction of a new <br /> single-family home. The new home would be built further away from the pond than the <br /> existing dwelling. There is no need for any relief from the setback requirements. The j <br /> proposed construction includes removal of the existing septic system and installation of a <br /> new denitrification septic system on the subject property. Proposed lot coverage would <br /> p <br /> be 6%. <br /> Mr. Borgeson read a letter from Attorney John S. White on behalf of`property owners <br /> who have concerns regarding construction of Horseshoe Bend Way' and the damage <br /> made by heavy machinery when a house is being constructed. The letter concluded with <br /> a request that `the builder be required to restore the road to usable condition whenever a ! j <br /> building permit is issued'. Mr. Brem questioned if emergency apparatus would have <br /> trouble accessing the road. Mr. Borgeson said that he visited the area and that the road <br /> has sustained damage and is difficult to navigate in certain areas. Mr. Brem said that the <br /> owners on the private road are responsible for the road's maintenance. !' <br /> Mr. Brem moved to grant a Special Permit, subject to the following: <br /> • findings 1 — 12. <br /> • Advanced Technology Solutions plan entitled `Sewage System Design for ! <br /> John & Lillian Chilingerian, 115 Kingston Rd., Waltham, MA, 02154, on <br /> 77 Horseshoe Bend Rd. Assessor's Ma 40 Pc 8-0-R Mashpee, MA, Date: l <br /> P p <br /> 12-10-01, Rev: 2-12-02'. <br /> • the Petitioner must post a Bond (amount to be determined by the Building <br /> Commissioner) for the before and after care of the entire road to guarantee <br /> that the road shall be restored to the condition it was before construction <br /> commenced at 77 Horseshoe Bend Way. it <br /> Ms. Elizenberry seconded.
