Leedham, Trustee, <br /> Shoestring Bay Nominee Trust of Mashpee, Massachusetts for a Special Permit under <br /> Section 174-25.I.9 of the Zoning By-laws to allow for reconstruction of an existing <br /> bulkhead and ramp on property located in an R-3 zoning district at 21 Frog Pond Close <br /> (Map 90 Parcel 83) Mashpee, MA. I� <br /> Notice was duly given to abutters in accordance with Massachusetts General I <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on April 5 and April 12, 2002, <br /> a copy of which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 24, 2002, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: James E. Regan III, Robert G. Nelson I� <br /> ,and Frederick R. Borgeson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. David Sanicki of Cape & Islands Engineering represented the Petitioner, <br /> Mr. Timothy W. Leedham, who also attended the meeting. Mr. Sanicki submitted <br /> photos of the marina and said that the proposal calls for reconstruction of the ramp I j <br /> and reconstruction and installation of a new bulkhead in front of and within the same <br /> footprint as the old bulkhead. The Conservation Commission has approved the project. <br /> Mr. Regan commented that the original Special Permit for the subject property II <br /> would be considered inadequate by today's standards and he expressed concern with <br /> Parking issues, signage and the long-term plan for the subject property. Mr. Leedham <br /> stated that he met with the neighbors to address their concerns about the long-standing <br /> Parking congestion and trash problems in the area. He submitted a copy of the set of I C L <br /> rules and regulations entitled `2002 Mashpee Neck Marina, Inc. Dockage/Mooring <br /> Contract Rules & Regulations', which lease agreement every person contracting to use I' <br /> the Marina is obligated to sign and obey. Mr. Leedham indicated that violation of the <br /> lease agreement would result in removal of the offending party from the subject property <br /> and a subsequent cancellation of that person's lease agreement with the marina. j III' <br /> Ilk <br /> I � III I i <br /> i <br />
