Leedham, Trustee 2 <br /> Board of Appeals Shoestring Bay Nominee Trust <br /> SP-02-59 <br /> Mr. Leedham, owner of Bosun's Marine, said that he plans to have `the main <br /> operation' at Bosun's Marine on Route 28. This would allow for consolidation of <br /> deliveries, orientations, demonstration models, etc. Mr. Leedham said that he has been a <br /> member of the community for over 17 years and feels a sense of responsibility as a local <br /> homeowner and business owner to clean the subject property and make it safe to use. Mr. <br /> Borgeson visited the site and agreed that the bulkhead is in need of repair and that the <br /> p <br /> proposal would be an improvement to the property and to the neighborhood. .j I <br /> No comments were received from abutters. <br /> !!i i ILII <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-2519 states that the Board must find that the structure will not unduly j <br /> interfere with the free passage of travel by water or land or cause or contribute <br /> to the substantial disruption or degradation of the marine or coastal environment. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 21 Frog Pond Close and contains 37,650 <br /> square feet fronting on Shoestring Bay. ! <br /> SPECIFIC FINDINGS <br /> I <br /> The Board determined that: <br /> 1. the proposed reconstruction is an accessory to an existing dwelling and is a <br /> permissible use upon the grant of a Special Permit. <br /> 2. the proposal has been approved by the Shellfish Constable, whose <br /> responsibilities include protection of the marine environment. <br /> I � I <br /> 3. the proposal has been approved by the Conservation Commission, whose <br /> responsibilities include addressing impacts on the coastal environment. <br /> 4. the use is in harmony with the general purpose and intent of the By-laws. <br /> 5. the owner has rights to maintenance in perpetuity. <br /> 6. filing with the State DEP Wetlands Program shall be considered execution of <br /> the Special Permit. <br /> I I i <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on April 24 <br /> 2002 to grant a Special Permit. The Special Permit is conditioned upon compliance with <br /> the following: <br /> 1.
