i <br /> TOWN OF MASHPEE <br /> Zoning Board of Appeals <br /> Minutes - Wednesday, May 22, 2002 <br /> The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, May 22, <br /> 2002, at 7:30 P.M. at the Mashpee Town Hall. Board Members present were Chairman <br /> Edward M. Govoni, Vice Chairman James E. Regan III, Clerk Robert G. Nelson and <br /> Associate Members Richard T. Guerrera, Zella E. Elizenberry, Frederick R. Borgeson <br /> and Marshall A. Brem. Building Commissioner Russell W. Wheeler and Local Building <br /> Inspector Richard E. Hawryluck also attended the meeting. <br /> PUBLIC HEARINGS <br /> Geome A. Benway III—Requests a Special Permit under Section 174-25.I.9 of the <br /> Zoning By-laws to allow for an existing walkway on property located in an R-3 zoning <br /> district at 12 Bay Road and adjoining marsh area(Map 114 Parcel 34) Mashpee, MA. <br /> Owner of record: Frank S. & Veronica F. Jurczak and Nicholas & Mary Catalina. <br /> Sitting: Edward M. Govoni, James E. Regan III and Robert G. Nelson. it <br /> Mr. Govoni read a letter dated May 21, 2002 from Mr. Benway requesting a continuance <br /> and a Withdrawal Without Prejudice of his Petition for a Special Permit. Mr. Regan Hi <br /> moved to accept the request for Withdrawal Without Prejudice of the Petition for a <br /> Special Permit, SP-02-64. <br /> Mrs. Margaret Moran, owner of property located at 28A Bay Road, attempted to address <br /> the Board. Mr. Govoni informed her that the hearing was closed and that she would be <br /> notified when Mr. Benway decides to re-file with the ZBA. Mr. Benway's Petition for a <br /> I <br /> Special Permit was filed incorrectly in that it did not list all of the properties on which the <br /> existing walkway was constructed. Mrs. Moran owns the property at 28A Bay Road, <br /> which is one of the properties on which Mr. Benway has constructed the walkway. Mrs. <br /> Moran said that she did not give permission for Mr. Benway to construct the walkway on ! ;' <br /> her property at 28A Bay Road. Mr. Govoni assured Mrs. Moran that she would have an i <br /> opportunity to address the Board at a future date. <br /> Town of Mashpee Shellfish Constable—Requests a Variance from Section 174-31 <br /> of the Zoning By-laws to vary the front and side setback requirements to allow for <br /> installation of a shed on property located in an R-3 zoning district at 88 Seconsett <br /> Island Road (Map 119 Parcel 100) Mashpee, MA. Owner of record: Town of Mashpee. <br /> Sitting: Edward M. Govoni, James E. Regan III and Robert G. Nelson. <br /> Shellfish Constable Richard H. York, Jr. represented the Petition and stated that plans call <br /> for installation of a 10x16-foot shed on the subject property. He said that the proposed <br /> location of the shed would not block the view of any of the abutters. Mr. York informed <br /> that Board that the shed would provide workers with shelter from the cold and wet <br />
