Mashpee Zoning Minutes—May 22, 2002 6 <br /> Board of Appeals <br /> PUBLIC HEARINGS <br /> Daniel L. Ocasio —Requests a Variance from Section 174-31 of the Zoning By-laws to <br /> vary the lot size and frontage requirements to allow for construction of a single-family <br /> home and garage on property located in an R-3 zoning district at 2 Bright Coves Way <br /> (Map 111 Parcel 41) Mashpee, MA. <br /> I <br /> Sitting: James E. Regan, Robert G. Nelson and Richard T. Guerrera. <br /> Mr. Ocasio represented the Petition and stated that Variance relief granted by the Board <br /> in 1998 has expired. He said that the proposed construction would meet the setback and <br /> lot coverage requirements and would provide adequate area for parking. Variance relief <br /> from the frontage requirements is needed due to the unusual trapezoid shape of the <br /> subject property. Mr. Ocasio said that the subject property is similar in size to other <br /> developed lots in the neighborhood, which do not meet the frontage requirements. <br /> No comments were received from abutters. <br /> Mr. Nelson moved to grant a Variance of 18 feet from the frontage requirements. Mr. <br /> Regan seconded. All agreed. I, " <br /> Denise M. Mills—Requests a Special Permit under Section 174-25.A.8 of the Zoning <br /> By-laws to allow for an in-law apartment in an existing dwelling on property located in <br /> an R-5 zoning district at 5 Wilann Road (Map 46 Parcel 9) Mashpee, MA. <br /> Sitting: Edward M. Govoni, James E. Regan III and Zella E. Elizenberr I' <br /> Y <br /> Mr. Regan announced that this is a Chapter 112 hearing. Ms. Mills represented her <br /> Petition and stated that the in-law apartment meets the 750 square-foot minimum. The j <br /> Board reviewed the submitted photos and proposed final construction. Building <br /> Commissioner said that the in-law apartment has already been constructed on the second <br /> floor. He said that a second egress is in the process of being installed. Mr. Wheeler <br /> informed the Board that he is assisting the Petitioner. <br /> The Board of Health memo indicates that the subject property is located in Zone 11 and <br /> that one of the existing bedrooms must be removed. <br /> ' I I <br /> No comments were received from abutters. <br /> I' I <br /> Ms. Elizenberry moved to grant the Special Permit, subject to findings for in-law <br /> apartments and that the Petitioner must provide proof that payment of all taxes has been <br /> made. Mr. Regan seconded. All agreed. <br />
