Benway III of Mashpee, <br /> Massachusetts for a Special Permit under Section 174-25.L9 of the Zoning By-laws to <br /> allow for an existing walkway on property located in an R-3 zoning district at 12 Bay <br /> Road and adjoining marsh area(Map 114 Parcel 34) Mashpee, MA. Owner of record: <br /> Frank S. & Veronica F. Jurczak and Nicholas &Mary Catalina. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on May 3 and May 10, 2002, a <br /> copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 22, 2002, at which time the following members of the Zoning Board I <br /> of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III <br /> and Robert G. Nelson. <br /> j <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. �I <br /> At the Public Hearings on May 22, 2002, Mr. Govoni read a letter dated May 21, <br /> 2002 from Mr. Benway requesting a continuance and a Withdrawal Without Prejudice of <br /> his Petition for a Special Permit. Mr. Benway's Petition for a Special Permit was <br /> submitted incorrectly in that it did not list all of the properties on which the existing <br /> walkway was constructed. The Board voted unanimously to accept the request for <br /> Withdrawal Without Prejudice of the Petition for a Special Permit, SP-02-64. <br /> Mrs. Margaret Moran, owner of property located at 28A Bay Road, attempted to I <br /> address the Board. Mr. Govoni informed her that the hearing was closed. Mrs. Moran's I ! <br /> property at 28A Bay Road is one of the properties on which the walkway was <br /> constructed. Mrs. Moran informed the Board that she did not give permission to Mr. <br /> Benway to construct the walkway on the property at 28A Bay Road. <br />
