Mashpee Zoning Town of Mashpee Shellfish Constable V-02-61 2 <br /> Board of Appeals <br /> I' <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. the close proximity to wetlands affects the subject property and not the district <br /> J p p Y <br /> in which it is located. <br /> 2. the subject property fronts on Little River and is impacted by wetlands; <br /> therefore, a literal enforcement of the By-laws would create a hardship for the <br /> Petitioner. <br /> 3. the subject property was created many years before adoption of zoning. <br /> 4. the size of the shed is negligible and installation on the subject property would <br /> not burden any of the abutters; therefore, relief may be granted without <br /> substantial detriment to the public good and without nullifying or substantially <br /> derogating from the intent or purpose of the by-law <br /> i <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded, the Zoning Board of Appeals voted unanimously on May 22, 2002 to <br /> grant a Variance of 15 feet from the setback requirements to Seconsett Island Road and a <br /> Variance of 6.5 feet from the setback requirements on the westerly boundary lot line. <br /> The Variance is conditioned upon submission of an original stamped and signed plan. <br /> The Petitioner submitted said plan to the office of the Zoning Board of Appeals, which <br /> plan is entitled `Shellfish Building Plan, Scale: 1"=20', Date: April 8, 2002', signed and <br /> stamped by David Charles Sanicki, Registered Professional Land Surveyor. <br /> SII <br /> I � <br /> � jail I' <br /> i I <br /> I' <br /> I <br /> I i <br /> li <br /> i <br /> 'i <br /> !I <br />
