Maher of l <br /> Woburn, Massachusetts for a Special Permit under Section 174-20 of the Zoning By-laws <br /> to demolish an existing dwelling to allow for construction of a single-family home on <br /> property located in an R-3 zoning district at 85 Bluff Avenue (Map 118 Parcel 59) <br /> Mashpee, MA. j I' <br /> Notice was duly given to abutters in accordance with Massachusetts General .i <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on June 7, and June 14, 2002, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 26, 2002, at which time the following members of the Zoning Board of 'I <br /> Appeals were present and acting throughout: Edward M. Govoni, Robert G. Nelson and <br /> Richard T. Guerrera. Mr. Regan stepped down and left the room. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. David Sanicki of Cape & Islands Engineering represented the Petition and j <br /> submitted photos of the subject property. Plans call for demolition of the existing home, <br /> which is currently 19.5 feet from the property line. Construction of the new family home I ' <br /> on the property would be 20 feet from the property line, which would be less detrimental <br /> than the existing dwelling. Mr. Sanicki stated that construction and placement of the <br /> septic system, which was configured in compliance with Title V requirements, restricts <br /> the location of the proposed home. There is no need for a Variance from lot coverage <br /> requirements. <br /> Ms. Shirley Boutilier, whose mother owns the abutting property at 81 Bluff <br /> Avenue, stated that she `loves the plan' and indicated that she would not object to the <br /> proposal.
