Quigley A-02-76 384 Monomoscoy Road <br /> Map 125 Parcel 20 <br /> A Petition was filed on May 30, 2002 by Debra L. Quigley of Mashpee, <br /> Massachusetts for an Appeal of the Building Commissioner's Decision to deny a <br /> building permit, which would allow for construction of a garage on property located j <br /> in an R-3 zoning district at 384 Monomoscoy Road (Map 125 Parcel 20) Mashpee, MA. I <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on June 7, and June 14, 2002, <br /> j <br /> a copy of which is attached hereto and made apart hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 26, 2002, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III and <br /> Robert G. Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A and the Town of Mashpee <br /> Zoning By-laws. <br /> ' I . <br /> Mr. David Sanicki of Cape & Islands Engineering represented the Petition and <br /> I, <br /> stated that the original plans, which the Zoning Board of Appeals approved in 1999, have <br /> been changed to replace the proposed garage with a large barn-type structure on the <br /> property. Building Commissioner Russell W. Wheeler refused to issued a building permit <br /> and demanded that the Petitioner return to the Zoning Board of Appeals for permission to <br /> revise the original plans, which change constitutes a structure which would be more <br /> detrimental. Mr. Quigley, the Petitioner's husband, attended the meeting and stated that <br /> _ <br /> he desires to store boats, boat trailers and other items inside the barn. Mr. Quigley said <br /> it i j <br /> that there is no living space planned in the proposed building. <br /> ! il <br /> II. <br />
