TOWN OF MASHPEE <br /> Zoning Board of Appeals <br /> Minutes - Wednesday, September 25, 2002 <br /> The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, <br /> September 25, 2002, at 7:00 P.M. at the Mashpee Town Hall. Board Members present <br /> were Chairman Edward M. Govoni, Vice Chairman James E. Regan III, Clerk Robert <br /> G. Nelson and Associate Members Marshall A. Brem and Zella Elizenberry. Mashpee <br /> Building Commissioner Russell Wheeler and Local Building Inspector Richard <br /> Hawryluck also attended the meeting. Associate Members Richard T. Guerrera and <br /> Frederick R. Borgenson were not in attendance. <br /> Continued Hearings: <br /> L. Clark Hill, Trustee: Requests an Appeal of the Building Commissioner's stop work <br /> order, to allow for construction of an accessory structure on property located in an R-3 <br /> zoning district at 50 Popponesset Island Road (Map 106 Parcel 24) Mashpee, MA. <br /> Sitting: Edward M. Govoni, James E. Regan, III and Robert G. Nelson. <br /> Mr. Kevin Kirrane faxed over an executed Continuance Notice to the Board of Appeals «r <br /> on Wednesday, September 25, 2002. Mr. Govoni moved to allow this petition to be <br /> y continued until October 23, 2002. Mr. Nelson seconded the motion. All agree. So <br /> moved. <br /> Carl & Maureen Fiester: Request a Variance from Section 174-31 of the Zoning <br /> k` By-laws to vary the side setback requirements to allow for construction of an in-law <br /> apartment to an existing dwelling on property located in an R-5 zoning district at 755 <br /> Old Barnstable Road (Map 78 Parcel 82) Mashpee, MA. <br /> Sitting: Edward M. Govoni, James E. Regan, III and Robert G. Nelson <br /> The Board discusses the setbacks in that district. Mr. Regan moves to grant the <br /> following: <br /> 1. a 9' variance from the side setback line of the Northeast corner with reference <br /> to the plan from J.
