Town of Mashpee <br /> 16 Great Xeck �kqad Xorth <br /> °tz MASHPEE ZONING BOARD OF APPEALS Mashpee, Massachusetts 02649 <br /> Decision for a Special Permit <br /> Re: Rockland Trust, Jean Canning, Trustee 5 Shellback Way <br /> SP-02-105 Map 81, Parcels 86, 87, 88 and 89 <br /> A Petition was filed on August 14, 2002 by Rockland Trust Company, Jean <br /> Canning, Trustee for a Special Permit under Section 174-25.F.6 of the Zoning By-laws to <br /> allow for construction of a commercial building with a drive-through window on property <br /> located in a C-1 zoning district at 5 Shellback Way (Map 81 Parcels 86, 87, 88, 89) <br /> I . <br /> Mashpee, MA. Owner of record: Jean Canning, Trustee. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on September 6 and <br /> September 13, 2002, a copy of which is attached hereto and made a part hereof. <br /> r A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 25, 2002, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan, III and Robert G. Nelson. <br /> f' The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Kevin Kirrane, and Mr. Donald Lonergan of DRL Associates, Inc. <br /> opened his presentation for the petitioner and proposes a bank with a drive-through <br /> window. This site was broken up into four commercial lots but has been redivided into 2 <br /> parcels of land. Access to the site is proposed to be on a 24 foot wide access easement. <br /> [_. Mr. Kirrane explains there is plenty of frontage on Route 28 and Shellback Way <br /> ` however, the Town Planner has required that this access easement tie into a proposed <br /> road that is situated on an adjacent Fields Point property. This would enable traffic to <br /> enter from Jobs Fishing Road and get to the Deer Crossing Complex without having to <br />
