Town o Mash ee <br /> �y. 16 Great Xeck Pgad Xorth <br /> OLE Decision for a Variance Mashpee,Massachusetts 02649 <br /> RE: Jen Zylinski v-02-103 70 Riverside Road <br /> Map 119 Parcel 67 <br /> A Petition was filed on August 2, 2002 by Jen Zylinski for a Variance from <br /> Section 174-31 of the Zoning By-laws for permission to vary the front and side setback <br /> requirements along with lot coverage requirements to allow for construction of a new <br /> dwelling, which would replace one of the three pre-existing, non-conforming dwellings <br /> located in an R-3 zoning district at 70 Riverside Road Ma 119 Parcel 67 Mashpee, <br /> g (Map ) <br /> -'' MA. Owner of record Jonathan and Lorraine Burtis. <br /> f" Notice was duly given to abutters in accordance with Massachusetts General <br /> t Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a x:=; <br /> f newspaper of general circulation in the Town of Mashpee, on September 6 and <br /> September 13, 2002, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 25, 2002 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan, III and Robert G. Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. David Sanicki, of Cape & Islands Engineering opened for the petitioner. Mr. <br /> �r <br /> Sanicki informed the Board that his client received a building permit in error before <br /> coming to the Board of Appeals to get a variance for the above property. The dwelling is <br /> already existing and maintains approximately the same footprint. The area previously <br /> 1 ,y refered to at the deck/porch is now square footage in the house. Mr. Nelson inquires <br /> 1 <br />
