Mashpee Zoning <br /> Board of Appeals Carl Fiester V-02-108 <br /> i <br /> 2 <br /> r <br /> which affect the subject property and not the district in which it is located; and that a <br /> literal enforcement of the By-laws would involve hardship to the Petitioner. <br /> SPECIFIC FINDINGS <br /> � The Board determined that: <br /> < 1. that a literal enforcement of the By-laws would involve hardship to the <br /> Petitioner. <br /> 2. that relief may be granted without detriment to the public good. <br /> 3. the shape and topography of the subject property limit placement of the <br /> s : proposed dwelling and septic system,therefore, a literal enforcement of the <br /> By-laws would involve hardship to the Petitioner. <br /> 4. the proposed construction would be farther away from the wetlands than the <br /> existing dwelling; therefore, relief may be granted without derogating from <br /> the intent or purpose of the By-laws. <br /> 5. installation of a new septic system would be an improvement to the subject <br /> 5 therefore, relief may be ranted without detriment to the public <br /> property; Y g <br /> good. <br /> r In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> t Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> r <br /> t <br /> 4` made and seconded, the Zoning Board of Appeals voted unanimously on September 25, <br /> 2002 to grant a Variance of 9 feet from the side setback line of the Northeast corner. <br /> The permit is conditioned upon compliance with plans from J.
