°"" Town o Mash ee <br /> I <br /> MASHPEE ZONING BOARD OF APPEALS 16 Great Seck load Xorth <br /> � Utz Mashpee, Massachusetts 02649 <br /> Request for Withdrawal Without Prejudice of Variance <br /> RE: Martin and Judith Wolff 5 Keel Way <br /> Map 120 Parcel 141 <br /> V-02-133 ! <br /> , i <br /> A Petition was filed on October 24, 2002, by Martin and Judith Wolff, requesting <br /> ; i <br /> a Variance from Section 174-33 of the Zoning By-laws to vary the setbacks for an <br /> existing deck 8 feet from the wetlands, and a proposed second floor deck that will <br /> cantilever 15 feet from the wetlands on property located in an R-3 zoning district at 5 <br /> Keel Way (Map 120 Parcel 141) Mashpee, MA. <br /> � k <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on j <br /> Wednesday, November 13, 2002, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry <br /> and Frederick Borgeson. <br /> John Slavinsky, Cape & Islands Engineering, represented the Petitioner. After j <br /> much discussion with the Board, it was determined that the proposed second floor deck <br /> will be constructed beyond the existing deck and therefore setting it back even further <br /> from the wetlands. The Board suggested to Mr. Slavinsky that a Variance is not needed I' <br /> i <br /> at this juncture.
