Minutes <br /> Mashpee Zoning Board of Appeals November 13, 2002 <br /> 7 <br /> require 50 feet. The proposed second floor cantilevered deck will be 15 feet and a <br /> Special Permit to construct the work. The front setbacks require 30 feet and they are at <br /> 27 feet. Lot coverage is 30% in a cluster area and they are at 20.1%. There is discussion <br /> whether or not a Variance is necessary. Mr. Nelson feels the front construction would <br /> not need any movement from the Board. The deck in the back is the concern as well as <br /> an addition that is inside the deck. This would make the pre-existing condition even <br /> farther away from the wetlands. Conservation has signed off on this matter. Mr. Nelson I ill <br /> feels the second floor deck is superfluous in needing a Variance. He also feels the <br /> petitioner does not really need to be here. He feels this particular hearing is a waste of <br /> time and effort. Petitioner is now basically looking for clean up on a pre-existing non- <br /> conforming deck. There is much discussion on this matter. Mr. Nelson feels this is not <br /> substantially more detrimental to the property or area. A new septic system is going in <br /> and this will be an improvement to the property. The Variance is withdrawn by Mr. <br /> Slavinsky. All agree. So moved. Mr. Borgeson moves to grant the Special Permit. <br /> Zella Elizenberry seconds. All agree.
