Board Members present were Chairman Edward <br /> M. Govoni, Vice Chairman James E. Regan III, Board Member Robert G.Nelson and <br /> Associate Members Zella E. Elizenberry, Richard T. Guerrera, and Frederick R. ., <br /> Borgeson. Building Commissioner William F. Hauck and Building Inspector Russell W. <br /> Wheeler were also in attendance. Marshall Brem was not present. <br /> OTHER BUSINESS <br /> yr <br /> Boston—Woman—Requests a Special Permit under Sections 174-25.E.2 and <br /> 174-25.H.6 of the Zoning By-laws for permission to construct a restaurant with <br /> accessory drive-through window and playground on property located in a C-2 <br /> zoning district at 486 Old Barnstable Road(Map 73 Block 47) Mashpee, MA. <br /> (Owner of record: Shellback Way Realty Trust.) <br /> A letter was received from Attorney Kevin M. Kirrane on behalf of the applicant seeking <br /> a continuance of the petition. Mr. Govoni moved to continue the hearing until March 8, <br /> 2000 to allow the applicant an opportunity to complete the Design Review process. Mr. <br /> Borgeson seconded. All agreed. ' <br /> PUBLIC HEARINGS <br /> Marcel J. Murad—Requests a Variance from Sections 174-31, 174-33 and 174-85 of <br /> the Zoning By-laws to vary the side setback requirements, to vary the setback from ff � <br /> water and wetlands and to vary the setback from the ACEC to allow for construction F <br /> of a swimming pool, patio and fence on property located in an R-2 zoning district at 19 <br /> Keel Way(Map 120 Block 138)Mashpee, MA. (Owner of record: Elen E. Murad, TR., r; <br /> Keel Way Real Estate Trust.) <br /> Sitting: Edward M. Govoni, James E. Regan III and Robert G.Nelson. ' <br /> I J <br /> Mr. Wayne Tavares represented the applicant and stated that the shape of the lot and the <br /> configuration of the existing house on the lot necessitate the Variance relief being sought. <br /> The proposal would encroach on the sideline setback by nine feet. Mr. Tavares said that <br /> the Great River is not a Conservation Commission concern and is not within the ACEC; <br /> therefore, the setback from the ACEC is no longer required. <br /> Mr. Tavares submitted photos and said that the proposed pool would add 692 square feet.
