Mashpee Zoning Minutes—January 12, 2000 4 1 . <br /> Board of Appeals <br /> ti Mr. Joseph Daniele of Monomoscoy Road said that he found out aboutMr. Keen's <br /> operation through an advertisement in a brochure. <br /> F" <br /> Mr. Ken Parolski of 351 Monomoscoy Road said that the Monomoscoy Improvement it <br /> y Trust does not speak for him. He also stated that the term"operation"really does not <br /> i= describe the small business that Mr. Keen conducts. Mr. Parolski expressed concern with <br /> the impact that a negative decision by the Board would have on other cottage industries <br /> in Mashpee. He said that this would amount to a"witch hunt"for people who are trying <br /> to conduct quiet, inconspicuous businesses in their homes. Mr. Parolski expressed " <br /> concern that people who knit, quahog or operate a computer-related business in their <br /> home would be issued cease and desist orders from the Building Commissioner. <br /> Attorney Mills reiterated that because of the ambiguity of the by-laws that the Board has <br /> the authority and the discretion to allow Mr. Keen to continue his operation in use. <br /> Mr. Bob Sampson of 398 Monomoscoy Road stated that Monomoscoy Island has been a <br /> fishing community since the early 1900's. He said that some of the large homes were <br /> originally small hunting or fishing cottages. Mr. Sampson said that he operates a <br /> commercial operation growing oysters and quahogs and is permitted by the Town,the <br /> state and the Army Corps of Engineers. Mr. Sampson said that family-run marinas set a <br /> precedent for home-based businesses a long time ago. <br /> Selectman David Leveille said that he talked to Elizabeth Lane from Koel <br /> p man and Paige ` <br /> who said that she did not have any additional information other than a request regarding <br /> the legality of operating a charter boat business in the area. Attorney Lane told Mr. <br /> Leveille that her job is to interpret the By-laws and she indicated that additional <br /> information would probably have no impact on her opinion. Mr. Leveille questioned if <br /> the Board plans on giving Town Counsel more information. <br /> Mark Burdis of Seconsett Island Trust suggested that majority voting taken at a meeting Mi <br /> does not necessarily reflect the consensus of everyone in the Trust. <br /> Mr. Keen said that he is permitted for one boat to take only 6 passengers at a time. He <br /> said that he caters to nice clients and has been a taxpayer in the Town of Mashpee for s <br /> more than 25 years.
