Mashpee Zoning Marcel J. Murad V-00-14 2 <br /> Board of Appeals <br /> Mr. Tavares said that the proposed lot coverage would be 27.5%, under the 30% <br /> allowed in cluster subdivisions. He stated that several neighbors in the area have also <br /> installed pools on their properties. <br /> r: <br /> The Conservation Commission has approved the proposal. <br /> Mr. Lloyd Gainsboro, a direct abutter at 15 Keel Way, expressed his approval of <br /> the project. No other comments were received from abutters. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 19 Keel Way and consists of 17,070 <br /> square feet. <br /> VARIANCE CRITERIA <br /> s ' Section 10 of Chapter 40A requires that the permit granting authority determine " <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> SPECIFIC FINDINGS <br /> 1. that the shape and topography affect the subject lot and not the district in <br /> which it is located. <br /> 2. that the subject property fronts on Great River and is impacted by wetlands. <br /> 3. that relief may be granted without detriment to the public good. <br /> =p 4. that relief may be granted without derogating from the intent or purpose of the <br /> 3 <br /> By-laws. <br /> f In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> applicant met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded the Zoning Board of Appeals voted unanimously on Januar 12 <br /> �. � g PP Y Y <br /> 2000 to grant the following: <br /> .j 1. a Variance of 5.24 feet from the pool area on the northerly side of the lot to <br /> �= P Y <br /> the 50-foot setback requirement to the water and wetlands. <br /> 2. a Variance of 9 feet from the easterly side of the lot to the property line. <br /> The Variance is conditioned upon compliance with plan entitled"Tavares Land Design, <br /> A Swimming Pool and Landscape Development Plan For: Marcel J.
