Gargiulo, Trs. SP-00-16 16 Pine Avenue <br /> Map 123 Block 42 <br /> A Petition was filed on December 1, 1999 by Barbara D. Gargiulo, Trustee, <br /> of North Andover, Massachusetts for a Special Permit under Section 174-20 of <br /> the Zoning By-laws for permission to demolish an existing building and construct <br /> a single-family dwelling on property located in an R-3 zoning district at 16 Pine <br /> Avenue (Map 123 Block 42)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on January 7 and January 14, <br /> 2000, a copy of which is attached hereto and made a part hereof. <br /> At the Public Hearings on January 26, 2000, the Board voted unanimously to <br /> continue the Petition until February 23, 2000 because of failure of the engineer to appear <br /> to represent the applicant. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 23, 2000, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Richard T. Guerrera, Zella E. <br /> Elizenberry and Frederick R. Borgeson. <br /> The Mashpee Zoning Board ofAppeals peals issue <br /> s this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. John Slavinsky of Cape &Islands Engineering represented the applicant <br /> and <br /> stated that the proposal is for demolition of the existing structure and construction of a <br /> new single-family home. The Board of Health has approved the proposal for installation <br /> of a new septic system. <br /> No comments were received from abutters. <br />
