SP-00-16 16 Pine Avenue Map 123 Block 42 A Petition was filed on December 1, 1999 by Barbara D. Gargiulo, Trustee, of North Andover, Massachusetts for a Special Permit under Section 174-20 of the Zoning By-laws for permission to demolish an existing building and construct a single-family dwelling on property located in an R-3 zoning district at 16 Pine Avenue (Map 123 Block 42)Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on January 7 and January 14, 2000, a copy of which is attached hereto and made a part hereof. At the Public Hearings on January 26, 2000, the Board voted unanimously to continue the Petition until February 23, 2000 because of failure of the engineer to appear to represent the applicant. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, February 23, 2000, at which time the following members of the Zoning Board of Appeals were present and acting throughout: Richard T. Guerrera, Zella E. Elizenberry and Frederick R. Borgeson. The Mashpee Zoning Board ofAppeals peals issue s this Decision pursuant to the provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of Mashpee Zoning By-laws. Mr. John Slavinsky of Cape &Islands Engineering represented the applicant and stated that the proposal is for demolition of the existing structure and construction of a new single-family home. The Board of Health has approved the proposal for installation of a new septic system. No comments were received from abutters.
