V-00-25 209 Ashers Path West <br /> Map 60 Block 40 <br /> A Petition was filed on December 28, 1999 by Kenneth& Gail Anderson, <br /> Trustees, of Mashpee, Massachusetts for a Variance from Sections 174-31 and 174-32 <br /> of the Zoning By-laws for permission to vary the lot size requirements and to allow for <br /> construction of a single-family dwelling on an unpaved road on property located in an <br /> R-5 zoning district at 209 Ashers Path West(Map 60 Block 40) Mashpee, MA. <br /> i <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on January 7 and January 14, <br /> 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 26, 2000, at which time the following members of the Zoning Board <br /> I <br /> of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III <br /> and Robert G.Nelson. <br /> I <br /> I <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Jeremy Carter represented the applicants and stated that they have <br /> owned the subject lot since 1963. The lot is larger than adjacent lots in the area and meets <br /> !I it <br /> the frontage requirements. Attorney Carter stated that Ashers Path West is a 40-foot <br /> wide unpaved road. Building Inspector Russell Wheeler confirmed that the road is wide <br /> and that other lots have been developed on the road. <br /> An abutter, Lewis H. Atkins, sent a letter to the Board in opposition to the � <br /> proposals. Mr. Atkins failed to specify the nature of his opposition. <br /> it <br /> Ms. Shirley Nurse Peters, an abutter, stated that the unpaved road does not pose a <br /> travel problem. She said that her lot and the subject lot are the largest lots in the area and <br /> that she has no objection to the proposal. No other comments were received from <br /> abutters. <br />
