No other comments were received from <br /> abutters. <br /> GENERAL FINDINGS <br /> i ; <br /> 1. that the subject lots are located at 195 and 203 Ashers Path West and consist it <br /> of a total of 48,196 square feet. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> SPECIFIC FINDINGS <br /> 1. that relief may be granted without detriment to the public good. <br /> 2. that relief may be granted without derogating from the intent or purpose of the <br /> By-laws. <br /> 3. that the shape and topography affect the subject lot and not the district in j <br /> which it is located. <br /> 4. that a literal enforcement of the By-laws would involve hardship to the <br /> petitioner. <br /> 5. that the lot has been maintained as a separate buildable lot on the Assessor's <br /> Records and is subject to betterments from the Water District. <br /> �i <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the j <br /> I� I <br /> applicant met the criteria necessary for the granting of a Variance. Upon motion duly �! <br /> j <br /> made and seconded, the Zoning Board of Appeals voted unanimously on January 26, <br /> 2000 to grant the following in accordance with plan entitled"Plan of Land in Mashpee, <br /> Mass., for Kenneth W. Anderson, Date: Sept. 10, 1973, Revised: Jan.22, 1974" and <br /> l <br /> recorded at Barnstable County Registry of Deeds in Book 283 Page 52: i <br /> 1. a Variance of 31,804 square feet from the lot size requirements for 195 and <br /> I� I <br /> 203 Ashers Path West and permission for 195 and 203 Ashers Path West to be <br /> combined into one buildable lot. <br /> � i <br /> 2. a Variance to allow for construction of a single-family dwelling on an <br /> unpaved road. <br />
