Furtado V-00-8 7 Seneca Avenue <br /> Map 65 Block 120E <br /> A Petition was filed on November 24, 1999 by Philip A. Furtado of East <br /> Falmouth, Massachusetts for a Variance from Section 174-31 of the Zoning By-laws <br /> to vary the front setback requirements to allow for construction of a single-family <br /> dwelling on property located in an R-3 zoning district at 7 Seneca Avenue (Map 65 <br /> Block 120E)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on January 7 and January 14, <br /> 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 26, 2000, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan III and Robert G. Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Furtado represented the applicant,his father, who also attended the meeting. <br /> Mr. Philip A. Furtado purchased the property at 7 Seneca Avenue in November 1999. <br /> There is apre-existing foundation on the property. When the subject lot was surveyed, <br /> , I <br /> the engineer discovered that the existing foundation encroaches on the front setback <br /> requirements by five feet. <br /> Mr. Michael Robbins, an abutter, expressed concern with the applicant using the <br /> modular home that has been sitting on the property for a number of years. Mr. Furtado <br /> confirmed that the applicant plans to install the modular home over the existing <br /> foundation. <br />
