Mashpee Zoning Mashpee Commons Limited Partnership <br /> Board of Appeals SP-00-43 2 <br /> upon community facilities created as a result of the proposal; and that there will not be a <br /> significant adverse impact on the environmental factors listed in Section 174-24.C.2. <br /> SPECIFIC FINDINGS <br /> 1. that the proposed use and development are consistent with applicable law, <br /> rules and regulations. <br /> 2. that there will be no adverse effect on public health or safety. <br /> 3. that there will not be an excessive demand upon community facilities created <br /> as a result of the proposal. <br /> 4. that there will not be a significant adverse impact on the environmental factors <br /> listed in Section 174-24.C.2. <br /> 5. that the applicant has satisfied the requirements under Condition#5 of the <br /> original Special Permit. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> applicant met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on February <br /> 9, 2000 to grant a Revision to the original Special Permit, SP-86-04-024, under Condition <br /> #5, subject to the following: <br /> 1. submission of signed, certified, engineered plans. <br /> 2. submission of a Performance Security in the amount of$150,000 to guarantee <br /> completion of the parking and landscaping as shown on the submitted plan. <br /> 3. no building permits shall be issued until the Applicant has submitted Design <br /> Review Site and Building plans to the Design Review Committee and has <br /> received the recommendation and approval of the Mashpee Zoning Board of <br /> Appeals, based upon the design recommendations of the Design Review <br /> Committee. <br /> 4. no building permits shall be issued for dwelling units until the Applicant has <br /> received approval from the Mashpee Zoning Board of Appeals. <br /> 5. the general location of the buildings and other improvements shown on the <br /> Master Plan for Mashpee Commons shall not be changed without the consent <br /> of the Mashpee Zoning Board of Appeals. <br /> 6. wherever the word"Applicant" is used in this Decision, it is intended to <br /> include successors in title or interest to the real property or any part thereof <br /> which is the subject matter of this Special Permit. <br /> 7. all perimeter and entry signage will be submitted for review to the Design <br /> Review Committee and will be subject to approval from the Mashpee Zoning <br /> Board of Appeals. Sign covenants governing interior signage for Mashpee <br /> Commons will be subject to the approval of the Mashpee Zoning Board of <br /> Appeals. <br /> 8. prior to the issuance of occupancy permits, the Mashpee Zoning Board of <br /> Appeals will satisfy itself that Landscaping shall have been completed, subject <br /> to accepted seasonal variations. <br /> I <br />
