Accordingly, the period of the zoning freeze afforded by Ch. 40A <br /> Sec. 6 elapsed; the 40,000 square foot requirement of Mashpee Zoning Bylaw Sec. 174- <br /> 31 controls, and Lot 171 is no longer buildable. <br /> COUNT 1 (vs. Susan Fort, Karen Wiener and James Salzer. Trustees) <br /> 20. The plaintiffs repeat the allegations contained in Paragraphs 1 through 19 of this <br /> Complaint. <br /> Wherefore the plaintiffs pray this Court as follows: <br /> a. That the court issue a temporary restraining order against the said <br /> defendants restraining them from commencing or continuing construction <br /> on Lot 171. <br /> b. That the court issue a preliminary injunction against the said defendants <br /> restraining them from commencing or continuing construction on Lot 171. <br /> C. That the court issue a permanent injunction against the said defendants <br /> restraining them from commencing or continuing construction on Lot 171. <br /> d. If a building permit shall have been issued for Lot 171, and if construction <br /> shall have commenced, that the Court issue an order requiring the <br /> defendants to remove any such construction or structure erected on Lot <br /> 171. <br /> e. For such other relief as justice and equity may require. <br /> COUNT 2 (vs. Mash <br /> pee Board of Appeals) <br /> 21.
