Brem. <br /> kit <br /> Mr. John Slavinsky of Cape &Islands Engineering represented the applicants. The <br /> Conservation Commission has continued the application until March 16, 2000. <br /> P r+,YI <br /> The Conservation Commission has required the construction to be 86 feet away + ; <br /> from the vernal pool. On January 6, 2000,the Conservation Commission required the <br /> engineer to revise the plan to indicate the work limit area and verify and certify that the <br /> area would be re-vegetated. On February 3, 2000,the Conservation Commission said <br /> that the By-law states that any proposed construction must be 100 feet from a vernal pool. 1 <br /> The applicants' proposal showed it to be 88 feet away from the vernal pool. The <br /> Conservation Commission suggested that the size of the house should be reduced and �, s <br /> then the applicant should apply to the Zoning Board of Appeals for a Variance. tK,►�, <br /> The size of the proposed construction was reduced by 232 square feet. Mr. Slavinsky <br /> stated that the proposal would have to be reduced by an additional 415 square feet in i <br /> order to conform to current zoning requirements. <br /> Mr. Govoni questioned Mr. Slavinsky if the Conservation Commission has approved the a <br /> submitted plan. Mr. Govoni stated that he talked to Bob Sherman and that the <br /> Conservation Commission has changed its mind three times. Mr. Govoni suggested that <br /> the Board wait to hear the Petition for a Variance until after the Conservation <br /> Commission has given its approval to a final plan. Mr. Brem confirmed that the Zoning <br /> Board of Appeals requires Conservation Commission approval prior to voting on a <br /> Petition. <br /> a <br /> No comments were received from abutters. <br /> Mr. Marshall moved to continue the hearing until March 22, 2000. Mr. Borgeson <br /> seconded. All agreed. <br /> Bay Ridge Construction—Requests a Special Permit under Section 174-20 of the <br /> Zoning By-laws for permission to remove an existing foundation and construct a <br /> single-family home on property located in an R-3 zoning district at 38 Quaker Run <br /> Road(Map 83 Block 22)Mashpee,MA. (Owner of record: Ellen M. Shepherd.) <br /> Sitting: Edward M. Govoni, Richard T. Guerrera and Marshall A.Brem. <br /> 4. <br /> j .. <br /> Mr. John Slavinsky of Cape & Islands Engineering represented the applicant and <br /> submitted photos of the subject lot. No Variance from the Zoning By-laws is being <br /> requested. He stated that demolition of the existing foundation and installation of a <br /> q <br /> new Title V septic system are planned.
