Litvack&Bertha Chang- Litvack 11 Taffrail Way <br /> SP-00-88 Map 106 Block 7 <br /> A Petition was filed on February 11, 2000 by Kenneth E. Litvack and Bertha <br /> Chang-Litvack for a Special Permit under Section 174-25.I.9 of the Zoning By-laws I 1 <br /> for permission to construct a pier, ramp and float on Popponesset Creek on property <br /> located in an R-3 zoning district at 11 Taffrail Way(Map 106 Block 7)Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on March 3 and March 10 <br /> 2000, a copy of which is attached hereto and made a part hereof. <br /> II I <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on j <br /> Wednesday, March 22, 2000, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: James E. Reg an III, <br /> Richard T. Guerrera <br /> and Frederick R. Borgeson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. David Sanicki of Cape &Islands Engineering represented the applicants and <br /> II <br /> stated that the Harbormaster has requested the relocation of the proposed float. The <br /> Conservation Commission hearing is scheduled for April 13, 2000. <br /> The Board voted unanimously to continue the hearing until May 10,2000 to allow <br /> the applicant to submit revised plans and to receive Conservation Commission approval. <br /> I I <br /> At the continued hearings on May 10, 2000, Mr. David Sanicki of Cape &Islands <br /> Engineering represented the applicants. Mr. Regan read the memo from the Shellfish <br /> it i I ' <br /> Constable requesting that float stops shall be installed to keep the float at least two feet <br /> above the bottom to prevent negatively impacting shellfish productivity.
