Jones SP-00-91 2 <br /> Board of Appeals <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 202 Daniel's Island Road and consists of <br /> 34,020 square feet. <br /> SPECIAL PERMIT CRITERIA <br /> I <br /> Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General <br /> Law Chapter 40A, Chapter 6, require a finding that the extension, alteration or change <br /> shall not be substantially more detrimental to the neighborhood than the existing <br /> non-conforming use. !' <br /> SPECIFIC FINDINGS <br /> li <br /> 1. that the proposed construction does not conform to the setback requirements <br /> and the Board has granted a Variance. <br /> II <br /> 2. that the proposal would not be substantially more detrimental than the existing <br /> structure. <br /> 3. that the proposal would enhance the lot. <br /> 4. that the installation of a new septic system would be an improvement to the <br /> lot. <br /> 5. that construction of a new home would be an improvement to the <br /> I � <br /> neighborhood. <br /> i <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that <br /> the applicant met the criteria necessary for the b <br /> pP y granting of a Special Permit. Upon <br /> motion duly made and seconded,the Zoning Board of Appeals voted unanimously on <br /> March 22, 2000 to grant a Special Permit to demolish the existing structures and ',I <br /> construct a single-family home on the subject property. The Special Permit is j <br /> conditioned upon compliance with Cape &Islands Engineering plan entitled: "Proposed <br /> Site Plan Located in Mashpee—Mass., Prepared for E.
