Vining. <br /> 91 <br /> Sitting: James E. Regan III, Robert G.Nelson and Richard T. Guerrera. <br /> r � <br /> r .. <br /> Mr. David Sanicki of Cape &Islands Engineering represented the applicant and stated <br /> that the applicant is requesting the same Variance that the Board previously approved in <br /> 1998. The Building Department did issue permits to the owners,the septic system was <br /> installed and a hole for the foundation was excavated. However, substantial construction r "1 <br /> (as determined by the Building Department and confirmed by Mr. Wheeler,Building <br /> Inspector)was not started prior to the one-year expiration date of the original Variance ' <br /> V-98-142. Mr. Sanicki said that there has been no change in plans. <br /> Mr.Nelson expressed concern with taxes not being paid up to date. Mr. and Mrs. Willis, <br /> Willco Builders, said that they could vouch for the owner. Board Secretary informed *� <br /> Mrs. Willis that taxes were in arrears. Mrs. Willis called Mrs. Vining who said that she <br /> sent a check to the Tax Collector. <br /> { <br /> Mr.Nelson also expressed a potential problem because there are different property ' <br /> owners for the subject parcels. Mr.Nelson said that the Board should not grant <br /> permission for a house to be built across a lot line with two different owners on the deeds. <br /> Mr. Regan asked Mr. and Mrs. Willis, builders for the project, if the owners would be S <br /> agreeable to resolve the discrepancy with ownership. Mr. Regan suggested that both lots F' <br /> should be registered under the same names or under the Trust name. ` *" <br /> a <br /> No comments were received from abutters. ; <br /> Mr.Nelson moved to grant a Variance of 13 feet from the front setback requirements, <br /> subject to the following: <br /> • that current taxes are paid up to date. <br /> • that lots 13 and 14 as shown on plan#100598 shall be combined into one lot. ►d , <br /> • that lots 13 and 14 shall be registered under the same ownership. <br /> • that the existing driveway shall be maintained. <br /> • same conditions as original Variance. <br /> Mr. Guerrera seconded.
