Owner of record: Larry I I' <br /> Codair. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> I <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a ;! <br /> newspaper of general circulation in the Town of Mashpee, on March 24 and March 31, j <br /> 2000, a copy of which is attached hereto and made a part hereof. J <br /> Ulm <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on I! II <br /> Wednesday, April 12, 2000, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: James E. Regan III, Robert G. Nelson <br /> and Marshall A. Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the I I I! <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of III 1 ii <br /> Mashpee Zoning By-laws. <br /> P g Y . <br /> I. I <br /> Ms. Megan Raymond, Environmental Consultant with LEC Environmental I I, <br /> Consultants, Inc. (LEC), represented the applicant,PAL Trust. Mr. Paul Lalito, Director j <br /> of Ecological Services at LEC also attended the meeting. Ms. <br /> g g Raymond stated that the <br /> lot is totally encompassed by the Waquoit Bay ACEC and is surrounded on the southern, <br /> western and northern property boundaries b a salt marsh. The 100-foot setback <br /> P p Y Y <br /> requirement precludes development of a single-family dwelling and the applicant wouldjli ��i <br /> suffer financial hardship. <br /> ISI i�I ,� <br /> The Board of Health has approved installation of a denitrification septic system. <br /> Loam, seeding and low-maintenance indigenous species for landscaping would also be j! <br /> installed to minimize nitrogen loading into Hamblin's Pond. <br /> Mr. Regan suggested that the Board continue the hearing to allow the applicant i <br /> an opportunity to submit proper documentation of ownership,to make payment of back III <br /> taxes,to install survey stakes on the subject lot and to receive approval from the <br /> Conservation Commission. The Board voted unanimously to continue the hearing until <br /> May 10, 2000. <br /> x <br />
