All agreed. <br /> PAULINE HICKS <br /> },. �•cM <br /> The Board received a memo from Town Planner F. Thomas Fudala dated 3/24/00. The ► <br /> memo referenced the decisions rendered by the Board regarding Variance applications *„ <br /> V-00-39 (10 Hicks Way), V-00-40 (22 Hicks Way), V-00-41 (26 Hicks Way) and <br /> V-00-42 (23 Hicks Way). Mr. Fudala quoted the Board's decision that it"does not have •"04«o <br /> the authority to act on the petitions until Mrs. Hicks goes back to the Planning Board for <br /> subdivision approval and for approval to have the road paved". a� <br /> Mr. Fudala informed the Board that the "subdivision plan" for these properties "was <br /> approved by the Planning Board in 1973 and is still a valid recorded plan. While it may <br /> be necessary to have some aspects of the road design, such as drainage, updated to meet <br /> current standards before construction, such construction under subdivision control would ' <br /> not appear to have any legal connection to pursuit of a variance under zoning. It would '` " .�A <br /> seem that Mrs. Hicks would want to know how many homes she will be able to build <br /> before committing to the expense of redesign and construction of Hicks Way". <br /> Mr. Regan moved to waive the filing fees and the abutters' fees for the subject lots on <br /> Hicks Lane when Mrs. Hick's attorney re-files the applications. Mr. Regan cited that the ^t4". <br /> previous filing was recently done in January 2000 and that there was some confusion as <br /> to the validity of the subject subdivision. Mr. Nelson seconded. All agreed. <br /> p. <br /> Mr. Nelson moved to accept the Minutes of the April 12, 2000 Public Hearings. Mr. <br /> Guerrera seconded.
