Daley V-00-115 219 Waterway <br /> Map 111 Block 74 <br /> A Petition was filed on April 4, 2000 by Stephen M. & Sarah A. Daley for a <br /> Variance from Section 174-31 of the Zoning By-laws for permission to vary the side and <br /> front setback requirements to allow for construction of a deck to an existing dwelling on <br /> property located in an R-3 zoning district at 219 Waterway(Map 111 Block 74) <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on April 7 and April 14, 2000, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on j <br /> Wednesday, April 26, 2000, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: James E. Regan III, Robert G. Nelson and <br /> Richard T. Guerrera. <br /> I <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of .;. <br /> Mashpee Zoning By-laws. <br /> Mr. Daley represented his application and stated that the proposal calls for the <br /> existing deck on the subject property to be rebuilt and expanded. The lot is surrounded <br /> by streets on three sides and requires Variance relief of approximately 10 feet in order to <br /> enhance the size of the existing deck. <br /> Mr. Guerrera questioned why the plan reflected neither a drawing of the proposal <br /> nor any dimensions. Mr. Daley said that he did not have a drawing of the actual project <br /> and referred to a hand-sketched document. <br /> The Board voted unanimously to continue the hearing to allow the applicant an <br /> opportunity to submit stamped engineered plans. <br /> I �; <br />
