Town of Mashpee <br /> MASHPEE ZONING BOARD OF APPEALS 16 Great JVeck ,`, 1 <br /> �Q• _ �y' Sorth � <br /> LE Nashpee, Massachusetts 02649 L? <br /> Decision for a Special Permit <br /> RE: Brickyard Marketplace Nominee Trust <br /> 93 Old Brickyard Road <br /> SP-00-114 (Signage 439 Nathan Ellis Highway <br /> Map 72 Blocks 22 & 23 <br /> A Petition was filed on March 27, 2000 by Brickyard Marketplace Nominee <br /> Trust for a Special Permit under Sections 174-51.B and 174-51.0 of the Zoning By-laws <br /> for permission to erect signage on properties located in R-5 and C-2 zoning districts at 93 <br /> Old Brickyard Road and 439 Nathan Ellis Highway(Map 72 Blocks 22 and 23) <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on April 7 and April 14, 2000, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on ; <br /> Wednesday, April 26, 2000, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: James E. Regan III,Robert G. Nelson and <br /> Frederick R. Borgeson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Day of Day Sign Co. represented the application. The Design Review <br /> Committee has approved the project. Mr. Berish, Trustee of Brickyard Marketplace <br /> Nominee Trust, said that this Petition is to request formal Board permission to erect <br /> signage on the subject property. Mr. Berish said that this is the only pedestal sign <br /> proposed for the site. <br /> Mr. Christopher Shute, an abutter, expressed concern that the proposed sign <br /> would impede a motorist's visual ability in trying to gain access to Route 151. After <br /> reviewing the plans, Mr. Shute indicated his satisfaction with the proposed location of the <br /> sign. No other comments were received from abutters. <br /> GENERAL FINDINGS <br /> 1. that the subject properties are located at 93 Old Brickyard Road and 439 <br /> Nathan Ellis Highway and consist of a total of 72,916 square feet. <br /> Upon motion duly made and seconded, the Zoning Board of Appeals voted <br /> unanimously on April 26, 2000 to grant a Special Permit for permission to erect signage r <br /> on the subject properties. <br /> I <br /> i <br />
