RE: Stephen Berish V-00-113 37 Keel Way Map 120 Block 133 A Petition was filed on March 21, 2000 by Stephen Berish of Mashpee, Massachusetts for a Variance from Sections 174-31 and 174-33 of the Zoning By-laws for permission to vary the rear and side setback requirements and the setback requirements from the water and wetlands to allow for construction of a jacuzzi, spa and Y� deck on property located in an R-3 zoning district at 37 Keel Way(Map 120 Block 133) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a r` newspaper of general circulation in the Town of Mashpee, on April 7 and April 14, 2000, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, April 26, 2000, at which time the following members of the Zoning Board of Appeals were present and acting throughout: James E. Regan III, Richard T. Guerrera and Frederick R. Borgeson. y z. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of Mashpee Zoning By-laws. Mr. Wayne Tavares of Tavares Land Design represented the applicant and stated that the total lot coverage would not exceed 10%with the proposed construction. He submitted for review a large drawing of the proposal. The setback of the proposed construction would match an existing setback granted by the Board in a previous Decision. The Conservation Commission has approved the project. No comments were received from abutters. Yrk
