Silva SP-00-102 105 Timberlane Drive <br /> Map 22 Block 22 <br /> A Petition was filed on February 29, 2000 by Stephen L. Silva of Mashpee, <br /> Massachusetts for a Special Permit under Section 174-20 of the Zoning By-laws for <br /> permission to demolish an existing structure and construct a single-family home on <br /> property located in an R-5 zoning district at 105 Timberlane Drive(Map 22 Block 22) <br /> Mashpee,MA. . <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on April 7 and April 14, 2000, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 26, 2000, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Mr. Regan stepped down and left the room. <br /> Richard T. Guerrera, Zella E. Elizenberry and Frederick R. Borgeson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Doyle of Stephen J. Doyle and Associates represented the applicant and <br /> stated that the proposal calls for demolition of an existing structure and construction of a <br /> new Cape-style dwelling on the subject property. The Conservation Commission and the <br /> Board of Health have approved the project. Due to the difficult topography of the lot,the <br /> Board has granted a Variance from the front setback requirements in order to comply <br /> with Conservation Commission concerns. <br /> No comments were received from abutters. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 105 Timberlane Drive and consists of <br /> 20,000 square feet. `u <br /> i <br /> s_ <br /> i <br />
