Silva of Mashpee, <br /> Massachusetts for a Variance from Sections 174-31 and 174-33 of the Zoning By-laws <br /> for permission to vary the front setback requirements and the setback requirements from <br /> the water and wetlands to allow for construction of a single-family home on property <br /> EY� <br /> located in an R-5 zoning district at 105 Timberlane Drive (Map 22 Block 22) Mashpee, <br /> MA. ; <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on April 7 and April 14, 2000, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 26, 2000, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Mr. Regan stepped down and left the room. <br /> Richard T. Guerrera, Zella E. Elizenberry and Frederick R. Borgeson. >t g <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the �} <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Doyle of Stephen J. Doyle and Associates represented the applicant and <br /> stated that the proposal calls for demolition of the existing structure and construction of a <br /> new Cape-style dwelling. The Conservation Commission and the Board of Health have <br /> approved the project. Due to the difficult topography of the lot, front setback Variance <br /> relief is being requested in order to comply with Conservation requirements. <br /> No comments were received from abutters. <br /> h.yY y <br /> I 1 <br />
