Board Members present were Chairman Edward <br /> M. Govoni,Vice Chairman James E. Regan III, Clerk Robert G.Nelson,Associate w <br /> Members Richard T. Guerrera, Zella E. Elizenberry, Frederick R. Borgeson and Marshall �►""!G <br /> A. Brem. Building Inspector Russell W. Wheeler also attended the meeting. <br /> PUBLIC HEARINGS A <br /> I <br /> Michael Cannata—Requests a Variance from Sections 174-31, 174-32 and 174-33 f� �•�� <br /> of the Zoning By-laws for permission to vary the setback requirements to the water <br /> and wetlands,to vary the fire protection requirements and to vary the front setback <br /> requirements to allow for construction of a single-family dwelling on a dirt road on <br /> property located in an R-3 zoning district at 4 Sakonnet Road(Map 58 Block 28) <br /> Mashpee, MA. Owner of record: Phillip D. Shapiro. :-411 � <br /> Sitting: Edward M. Govoni, James E. Regan III and Robert G.Nelson. <br /> Mr. Cannata represented his application and stated that, due to the small size of the lot,he <br /> is requesting permission to vary the setback requirements to allow for construction of the <br /> proposed sun deck. One corner of the proposed deck would be 21 feet from the front lot 1 . <br /> line and another corner would be 35 feet from the water and wetlands. The proposed <br /> foundation meets all the setback requirements. J <br /> Two abutters (members of the John's Pond North Cove Association) expressed interest in , <br /> the proposal and questioned if the lot was a buildable lot. Mr. Govoni said that State <br /> Code allows for a minimum lot size of 5000 square feet and 50-foot frontage. The <br /> subject lot is "grandfathered"because it was created back in the 1960's,prior to zoning. { <br /> Mr. Govoni clarified that two or more contiguously-owned lots would have to be <br /> combined into one lot. Lots under separate ownership are"grandfathered"forever. °` <br /> „7 <br /> w , <br /> Mr. Sabatini, an abutter, examined the plans and questioned the exact setback figures of <br /> the proposed construction. Mr. Govoni said that the lot pre-dates zoning and actually <br /> does not have any setbacks. Mr. Govoni said that the Variances being requested are not <br /> unreasonable and that, in his opinion, granting a Variance for construction of a sun deck <br /> would not be detrimental to the neighborhood. <br /> w <br /> Mr. Sabatini also questioned the location of the septic system. Mr. Cannata said that the <br /> septic system would be installed in the rear of the lot. The new construction would be <br /> hooked up to Town water. Mr. Sabatini expressed concern that the new construction y <br /> 00 r <br /> would cause water run-off onto his lot.
