Owner of record: <br /> Phillip D. Shapiro. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on May 26 and June 2, <br /> 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 14, 2000, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, James E. Regan 111 and <br /> Robert G.Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Cannata represented his application and stated that, due to the small size of <br /> the lot, he is requesting permission to vary the setback requirements to allow for <br /> construction of the proposed sun deck. The proposed foundation meets all the setback <br /> requirements. <br /> Mr. Sabatini, an abutter, expressed concern that the new construction would cause <br /> water run-off onto his lot. Mr. Govoni said that the Building Department would require <br /> the applicant to resolve that matter before proceeding with the proposal. Mr. Cannata <br /> stated that cement retaining walls pitched with grade would be installed on the subject <br /> property. <br /> The Conservation Commission has approved the project. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 4 Sakonnet Road and consists of 6,448 <br /> square feet. <br />
