Board Members present were Chairman Edward <br /> M. Govoni, Vice Chairman James E. Regan III, Clerk Robert G.Nelson,Associate <br /> Members Richard T. Guerrera, Zella E. Elizenberry, Frederick R. Borgeson, and ! <br /> Marshall A. Brem. Building Inspector Russell W. Wheeler also attended the meeting. <br /> CONTINUED HEARINGS <br /> E. Gerard Keen-Requests an Appeal under Section 174-2516 of the Zoning By-laws <br /> to overturn the Building Commissioner's decision and to allow persons to embark and <br /> disembark for purposes of seasonal charter fishing trips on property located in an R-3 <br /> zoning district at 426 Monomoscoy Road (Map 124 Block 51)Mashpee, MA. <br /> Continued from January 12, January 26, May 10, 2000 to allow for Town Counsel <br /> opinion and research on grandfathering of use/shed. <br /> Sitting: Edward M. Govoni, James E. Regan III and Robert G.Nelson. <br /> Mr. Govoni stated that he has been communicating with Town Counsel. Dr. Keen has r� <br /> submitted new evidence regarding his Petition to the Board. The evidence includes <br /> income tax forms proving that he has been operating his charter fishing business for over <br /> 12 years, a copy of his Captain's license and proof of installation of a shed on the <br /> property for the purpose of the charter business several years ago. <br /> Mr. Govoni stated that he asked Town Counsel to research if"use is grandfathered and if <br /> there is a structure, does use follow the structure and is that grandfathered?" Town •'' :: �' <br /> Counsel indicated that they would follow up with a written opinion. The Board has not p <br /> received the opinion at this time. <br /> f <br /> Mr. Regan moved to continue and extend for 90 days the Petition and the time for the <br /> Board to render a Decision on the above-referenced Petition. Mr. Govoni seconded.
