°"NTown of Mashpee <br /> my <br /> N <br /> MASHPEE ZONING BOARD OF APPEALS 16 Great Xeck Pvoad Xorth <br /> Mashpee,Massachusetts 02649 � <br /> Decision for a Variance <br /> RE: Earl Cash, Jr. V-00-144 12 Terry Avenue <br /> Map 71 Block 9 <br /> A Petition was filed on June 28, 2000 by Earl Cash, Jr. of Mashpee, <br /> Massachusetts for a Variance from Section 174-25.I.2 of the Zoning By-laws for <br /> permission to park more than one commercial vehicle on property located in an R-3 <br /> zoning district at 12 Terry Avenue (Map 71 Block 9)Mashpee, MA. Owner of record: <br /> Marnell Cash. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on July 21 and July 28, <br /> 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> August 9, 2000 and continued to November 22, 2000, at which time the following II'I <br /> members of the Zoning Board of Appeals were present and acting throughout: <br /> James E. Regan III, Frederick R. Borgeson and Marshall A. Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the I' <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town I' <br /> of Mashpee Zoning By-laws. <br /> Mr. Cash represented his Petition and stated that he owns Eagle Limousine and <br /> Taxi Service. He is licensed to operate two taxis and one livery vehicle. One taxi is <br /> parked at the home of one of his employees and the other taxi is parked at Mr. Cash's <br /> home. Mr. Cash remarked that it would be more convenient to have an additional taxi <br /> parked on his property since he runs a 24-hour taxi business. He requested the Board's <br /> permission to park two commercial vehicles at a time on his property. The vehicles are <br /> L' <br /> serviced off-site. <br /> Mr. Govoni read the memo from Town Planner F. Thomas Fudala expressing <br /> concern with the Petition. Mr. Govoni stated that the By-law is vague regarding an <br /> individual struggling to run a home-based business. <br /> h <br />
