GIlill<oy4}p.,
Mashpee Zoning Minutes—August 23, 2000 3
Board of Appeals
d 14,u
Ms. Patricia Oakley, owner of 71 Main Street, asked if the Board had contacted any other ''gl*
Cape towns that have dormitory-style facilities. Mr. Regan confirmed that he had
gathered some information from the Falmouth and said that the gaps in Mashpee's zoning '4
by-laws cause concern for the residents.
Mr. Chuckie Green, a resident at 105 Main Street, voiced concern with a large group of
young people living together for extended periods of time and creating noise and other
problems in the neighborhood. He said that the neighborhood is currently very quiet and
that a.lot of the people living on Route 130 do not lock their doors. Mr. Green said that giN M
many of the elderly living in the neighborhood are concerned with their safety. He also t,
stated that there are no other motels in Mashpee.
Ms. Anna Lewis, a resident at 101 Main Street for more than 20 years, expressed her
approval of the way that Dr. and Mrs. Soliz have run the motel. She said that she iss
proud of where she lives and is opposed to the dormitory-type use of the subject
properties. Ms. Lewis said that most of the homes on Route 130 have been improved
over the years and that she does not want the neighborhood to be "ruined"with young
people moving into the area.
Mr.Brem said that New Seabury is "going ahead with this project, whether this is
approved or not approved" by the Board. He informed those at the meeting that New
Seabury has the right to use the properties as a motel and would move its employees from
one unit to another every 29 days. Mr. Brem said that New Seabury is trying to explain
the proposal to the neighbors. pIIaP
Ms. Cowan informed the Board that"if it does not stay up to the standard, then I will
personally make sure that it gets shut down as a motel. I'm not going to sit here and '!'f; "`°'10I ►"
allow it to go through for any other use;because if they were above-board in doing it and
going to maintain it to the level that they say, then it shouldn't be a problem. But, to
obviously they know what the issues are there. New Seabury has lots—they can build
dormitory-style houses and get a variance up there and put it on their own property"and 4Nr.rI
"I don't want it my neighborhood and I don't think you should approve it".
Mr. Greg Peters said, "we sat down in good faith"when the motel was started and we
"set down certain guidelines that were supposed to be followed"with the operation and
size of the motel. He said; "I don't like the way you keep referring to everything as one
piece of property." Mr. Peters said that he is opposed to the motel being changed from ar
motel to a dormitory. He referred to a ZBA decision from 1982 that required the
installation of a fence on the properties. It was discovered that the decision was not ,111a
recorded at the Barnstable County Registry of Deeds. Mr. Peters complained that the
Board did not record the decision. Mr. Brem corrected Mr.Peters and told him that the 40Il
Petitioner records the decision. Mr. Peters repeated that he wants the motel and the
Special Permit to remain the same.
„Ir f
