I Notice was duly given to abutters in accordance with Massachusetts General I Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on August 25 and September 1, 2000, a copy of which is attached hereto and made a part hereof. i A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, September 13, 2000, at which time the following members of the Zoning Board of Appeals were present and acting throughout: Edward M. Govoni, Robert G. Nelson and Frederick R. Borgeson. This Petition has been continued from the September 13, 2000 Public Hearings to allow the Petitioner to request from the ZBA a Variance from the setback requirements to water and wetlands. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of Mashpee Zoning By-laws. I Mr. Michael Grotzke of the Phoenix Group represented the Petition and stated I . that the proposal calls for construction of a new home within the ACEC. The Board has granted a Variance from the setback requirements to water and wetlands to allow for construction of a single-family home on the subject property.
