Mash <br /> f <br /> MASHPEE ZONING BOARD OF APPEALS <br /> 16 great JVeck load J�orth <br /> Mashpee, Massachusetts 02649 <br /> Decision for a Special Permit <br /> RE: Chilton Development SP-00-172 Map 105 Block 233 <br /> 132 Waterway <br /> A Petition was filed on August 17, 2000 by Chilton Development of Mashpee, <br /> Massachusetts for a Special Permit under Section 174-17 of the Zoning By-laws for <br /> permission to demolish an existing structure and construct a single-family dwelling <br /> on property located in an R-3 zoning district at 132 Waterway(Map 105 Block 233) i <br /> Mashpee, MA. <br /> I <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> I <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on August 25 and <br /> September 1, 2000, a copy of which is attached hereto and made a part hereof. i <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 13, 2000, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, Robert G. <br /> Nelson and Frederick R. Borgeson. <br /> This Petition has been continued from the September 13, 2000 Public Hearings to <br /> allow the Petitioner to request from the ZBA a Variance from the setback requirements to <br /> water and wetlands. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> I <br /> Mr. Michael Grotzke of the Phoenix Group represented the Petition and stated <br /> I . <br /> that the proposal calls for construction of a new home within the ACEC. The Board has <br /> granted a Variance from the setback requirements to water and wetlands to allow for <br /> construction of a single-family home on the subject property. <br /> I � <br /> The Conservation Commission has approved the project. <br /> No comments were received from abutters. <br /> r. <br /> i <br /> i <br />
