Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on August 25 and <br /> September 1, 2000, a copy of which is attached hereto and made a part hereof. i <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 13, 2000, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, Robert G. <br /> Nelson and Frederick R. Borgeson. <br /> This Petition has been continued from the September 13, 2000 Public Hearings to <br /> allow the Petitioner to request from the ZBA a Variance from the setback requirements to <br /> water and wetlands. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> I <br /> Mr. Michael Grotzke of the Phoenix Group represented the Petition and stated <br /> I . <br /> that the proposal calls for construction of a new home within the ACEC.
