Mashpee Zoning Minutes—September 13, 2000 4 <br /> Board of Appeals <br /> Mr. Russo informed the Board that Massachusetts and the state of California have the �A.. <br /> strictest VOC (volatile organic compounds)requirements in the United States. Mr. Russo <br /> said that the Department of Environmental Protection Agency monitors the use of ° 4. <br /> products in the auto body business. <br /> Mr. Russo said that a lot of the concerns that the Board of Health has appears to be "more I �h <br /> suspicion than it is factual". He also expressed concern that the residents have been o'' <br /> frightened by suspicions, not facts. <br /> Mr. Russo referred to Costa Auto Body on Carriage Shop Road, Teaticket Auto Body and <br /> Houtanen's Auto Body in West Barnstable that abut residential zones. These auto body <br /> shops have not had problems with noise or pollution. Mr. Russo requested example cases <br /> M, <br /> and evidence of an auto body shop operation being a real and substantial problem to the <br /> environment or to the neighborhood. I� <br /> h u. '+r H►n.l <br /> One resident of Southport asked if the auto body shop could be located in the industrial <br /> qul' <br /> park. The Board informed her that it is not an allowable use in that area. <br /> Mr. Speen of Southport was concerned that the auto body repair shop would"buy wrecks <br /> and repair them" and the potential for an unsightly mess. <br /> Mr. Tyrone Goodart, 5 Rolling Green, made reference to use of peroxide in the auto body <br /> shop. J11 , <br /> 14,10- <br /> Mr. Norman Zarek said he was the "expert witness" and started a lengthy dissertation on <br /> the consequence of certain chemicals on the human body. He referred to styrene, body , <br /> putty, peroxide and various other chemicals that would enter the air. Mr. Zarek said that <br /> the auto body shop would subject the residents of the trailer park to "all the ugliness of all <br /> the equipment and the odor". <br /> Mr. Zarek submitted photos of what he called"typical auto body shops". Mr. Haney said <br /> that the photos are of auto body shops in the Boston area. { <br /> Mr. Alfred Benjamin, Kettle Lane, commented that the presentation was a very nice <br /> presentation. He claimed that Zoning is "to protect the majority of the people against the <br /> individual" and that"as long as the majority thinks that it is wrong to have this shop in <br /> this particular area, that's what the Zoning Board should really pay attention to". <br /> Mr. William Haney, owner of the trailer park, said that he owns all the property around <br /> 1 dlPalni1i'd <br /> the subject lots as well as 115 more acres in the Town of Mashpee. He referred to a letter , <br /> and a petition signed by the residents of the trailer park in opposition to the project. Mr. <br /> Haney insisted on reading Sections of the Zoning By-laws to the Board. Mr. Govoni <br /> assured Mr. Haney that the Board knows the Zoning By-laws. Mr. Haney said that the <br /> "Board's fiduciary right in this situation is to deny the permit" and that he is not in favor 414 <br /> of this proposal in this part of Town. <br /> ^9 fl <br />
