Farrelly of <br /> Duxbury, Massachusetts for a Modification to Variance, V-99-71, under Section 174-33 j <br /> of the Zoning By-laws for permission to vary the setback requirements to water and <br /> wetlands to allow for construction of a deck to an existing dwelling on property located <br /> in an R-3 zoning district at 31 Starboard Lane (Map 118 Block 16)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a l <br /> newspaper of general circulation in the Town of Mashpee, on September 15 and <br /> September 22, 2000, a copy of which is attached hereto and made a part hereof. <br /> r J� <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 4, 2000, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III <br /> and Frederick R. Borgeson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the !' <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. j <br /> Attorney Mark Gildea represented the Petition. Mr. and Mrs. Farrelly attended <br /> the meeting along with Messrs. Jack Kuchinsky, engineer, and Joe Tarabelli, builder. I' <br /> ci <br /> Attorney Mark Gildea stated that Mr. and Mrs. Farrelly purchased the subject <br /> property in January 1999 with initial plans to make an addition to the existing dwelling. <br /> However, the Building Commissioner informed the new owners that the block foundation <br /> would not provide sufficient support to the dwelling. Plans were changed to demolish the <br /> existing dwelling, replace the foundation and reconstruct a new building within the same <br /> footprint. <br /> On October 13, 1999, the ZBA granted the Petitioner a Variance,V-99-71, of <br /> 23.6 feet from the setback requirements to the water and wetlands to allow for <br /> construction of the home. No abutters expressed opposition to the proposal. <br /> Attorney Gildea said that during construction, the Building Department required <br /> the <br /> installation of a landing placed outside the door leading to the stairs to allow for safe <br /> egress and ingress to the dwelling. <br /> Ij <br />
