I.1 p'01 1��11 I <br /> I <br /> Mashpee Zoning Minutes—October 11, 2000 5 <br /> Board of Appeals <br /> Attorney Sousa said that the problem was that FEMA would use the old Town maps that <br /> are inaccurate. He said that Mr. Miller hired an engineer and the physical survey reveals <br /> that the house is outside the flood zone. Mr. Miller said that he has done everything he <br /> can do to resolve the problem. ,I . <br /> Mr. Hauck said that stairs to the basement can be installed. Mr. Miller said that he <br /> desires to move the furnace from the kitchen into the basement area. <br /> "illill��p„ <br /> Mr.Nelson asked for a stamped, signed engineering plan of the site. Attorney Sousa said , <br /> that the original is in the Building Department files. Mr.Nelson asked for the basement <br /> floor elevation. Attorney Sousa indicated that the top of the foundation is 11.5 feet and „Icr <br /> e basement floor would be 7.9 feet below that. <br /> AttorneySousa said that a retaining wall four feet hi <br /> g high and 21 feet in length has been <br /> constructed away from the foundation. IN <br /> Mr. Hauck said that the Town has been threatened to have its flood insurance canceled <br /> because basements (with utilities)have been discovered to be in the flood plain. Mr. <br /> Hauck said that if the Petitioner would submit a proposal on the history of the property, <br /> he would be able to send the Petition to the Department of Environmental Management <br /> for an opinion. <br /> Mr.Nelson said that several articles of the Zoning By-laws affect the proposal and <br /> expressed concern with flood insurance being canceled in Town. i <br /> I. <br /> Attorney Sousa submitted a copy of the Building code for flood proofing in 3107 series. <br /> He said that the proposed level of work is only$20,000 and would not be a substantial <br /> improvement(50%)to the home. <br /> Mr. Regan asked the amount of time to get a reply from Department. Mr. Hauck said that <br /> it would take a couple of weeks. <br /> Mr.Nelson moved to continue the hearing until December 13, 2000 to allow the <br /> Petitioner an opportunity to receive an opinion from the Department. Mr. Guerrera <br /> seconded. All agreed. <br /> Jeanne S.
