Gardner, et al Trustees V-00-210 175 Surf Drive <br /> Map 102 Block 14 <br /> A Petition was filed on November 6, 2000 by Joseph P. Gardner, et al Trustees of <br /> Westborough,Massachusetts for a Variance from Sections 174-47.B.8 and 174-33 of the <br /> Zoning By-laws for permission to vary the front setback requirements and setback <br /> requirements from water and wetlands to allow for construction of a single-family home <br /> on property located in an R-3 zoning district at 175 Surf Drive(Map 102 Block 14) <br /> Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on November 24 and <br /> December 1, 2000, a copy of which is attached hereto and made a part hereof. <br /> At the request of Engineer Edward L. Pesce,the Petition was continued from the <br /> December 13, 2000 Public Hearings to allow the Petitioner an opportunity to receive <br /> Conservation Commission approval. A Public Hearing was held on the Petition at the <br /> Mashpee Town Hall on Wednesday, January 10, 2001, at which time the following <br /> members of the Zoning Board of Appeals were present and acting throughout: Edward <br /> M. Govoni, James E. Regan III and Robert G.Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Engineer Edward L. Pesce represented the Petition and stated that the Zoning <br /> Board of Appeals granted a Variance on the subject property in 1995 to allow for <br /> construction of a single-family home. Mr. Gardner also attended the meeting. <br /> In 1999,the Conservation Commission's Order of Conditions expired and the <br /> Petitioner had to go through the permitting process again. Mr. Pesce said that the <br /> foundation has been laid and the house has been framed. <br />
