V-00-221 2 <br /> Board of Appeals <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 72 Horseshoe Bend Way and consists of <br /> 12,600 square feet. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. without relief the lot could not be used for a residence,the purpose for which <br /> it had been laid out and for which the balance of the undersized lots in the { <br /> subdivision were being used;therefore, a literal enforcement of the By-laws <br /> would involve hardship to the Petitioner. <br /> 2. that the lot has been maintained as a separate buildable lot on the Assessor's <br /> Records and is subject to betterments from the Water District. <br /> 3. fire-fighting apparatus and emergency vehicles can access the subject road. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly } <br /> made and seconded, the Zoning Board of Appeals voted unanimously on December 13, <br /> 2000 to grant a Variance to allow for construction of a home on an unpaved road on <br /> property located at 72 Horseshoe Bend Way. The Variance is conditioned upon <br /> compliance with Professional Building System plan entitled"Site Plan and Sewage <br /> System Design for Professional Bldg. System, 319 Centre Ave.,Rockland,MA., <br /> 02370, on 72 Horseshoe Bend Way,Assessor's Map 40 Pc. 16, Mashpee,MA 02649, <br /> Date: 11-1-00". <br />
