I <br /> Mashpee Zoning Minutes—December 13 2000 <br /> Board of Appeals <br /> Zoning By-laws for permission to vary the side and rear setback requirements,the lot <br /> coverage requirements and the setback requirements to water and wetlands to allow for <br /> construction of a single-family home on property located in an R-3 zoning district at 81 an <br /> Nick Trail (Map 117 Block 99)Mashpee, MA. <br /> Sitting: Robert G.Nelson,Richard T. Guerrera and Zella E. Elizenberry. <br /> Mr. David Sanicki of Cape & Islands Engineering represented the Petitions and stated <br /> that the proposal calls for demolition of the existing structure and rebuild of a new home j <br /> within the same footprint. The Conservation Commission has approved the project. ~` <br /> Board of Health has approved the removal of two existing cesspools within 20 feet of a ff <br /> dune and installation of a new Title V septic system on the subject property. Illli �Il <br /> Mr. Sanicki clarified that the ten-foot strip that appears on the Assessor's map is actually <br /> part of the abutting lot. <br /> r <br /> Mr. Hauck said that construction of the cantilevers is a setback requirement and is <br /> considered part of lot coverage. He stated that means of egress is not included in the 1 <br /> setback requirements. However, Mr. Hauck challenged the Petitioner's calling a means <br /> of egress construction of a deck across the whole front of the house. He said that a <br /> 4x6-foot platform would be considered a reasonable means of egress. Mr. Hauck said r <br /> that construction of a deck would require a Variance from the front, side and rear setback <br /> requirements. <br /> Mr. Nelson made note of the fact that the plans do not reflect what is actually proposed. <br /> No comments were received from abutters. 41 <br /> Ms. Elizenberry moved to continue the Petitions until 1/24/01 to allow the Petitioner an i!I <br /> opportunity to submit revised plans. Mr. Guerrera seconded. All agreed. <br /> CONTINUED HEARINGS FOR DECEMBER 13 2000 <br /> World Gym of Cape Cod—Requests a Special Permit under Sections 174-25.B.11 and <br /> 174-25.H.6 of the Zoning By-laws to allow for mixed use of trade,professional and <br /> educational to accommodate nutritional programs, fitness counseling, fitness training and <br /> aerobic instruction on property located within the Groundwater Protection District in an <br /> I-1 zoning district at 106 Falmouth Road(Map 54 Block 5)Mashpee, MA. Owner of <br /> record: Duck Pond Limited Partnership.. Continued from 10/11/00 to allow for Town <br /> Counsel opinion. <br /> Attorney Rob Mills asked for a continuance/extension of the Petition to allow for Town p 4i <br /> Counsel opinion.
