Wheeler stated that part of the addition could A <br /> be used as an accessory building to store certain equipment. No manufacturing would be <br /> allowed. B <br /> VARIANCE CRITERIA <br /> 14 <br /> ll t Section 10 of Chapter 40A requires that the permit granting authority determine <br /> =a <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> ;s. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 109 Great Pines Drive and consists of <br /> 14,886 square feet. <br /> { <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. the subject property is located on a cul-de-sac; therefore,the shape affects the <br /> 5;z <br /> � r subject lot and not the district in which it is located. <br /> Buz; 2. the location of the septic system dictates the placement of the proposed <br /> i <br /> r addition; therefore, a literal enforcement of the By-laws would involve <br /> 7 <br /> hardship to the Petitioner. <br /> r proposal e.3thro l would be an improvement to the neighborhood; therefore, relief <br /> p p p <br /> may be granted without detriment to the public good. <br /> k� I <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded,the Zoning Board of Appeals voted unanimously on January 10, <br /> 2001 to grant a Variance of 12 feet on the southerly corner of the lotfrom the proposal to <br /> `Fl Shadbush Road. The Variance is conditioned upon compliance with the following: <br /> 1. plan entitled: "Plan of Land in New Seabury, Massachusetts with Proposed <br /> Garage Addition Location, Owned by Gary W. & Teresa L. Pearson, at 109 <br /> Great Pines Drive,New Seabury, MA., Prepared by Carmen E. Shay, <br /> Environmental Services,Inc., Date: Nov. 18, 2000". <br /> 2. per Town of Mashpee Zoning By-laws,the proposed addition shall not be <br /> used to conduct a commercial business. <br /> w <br />
