V-01-4 2 <br /> Board of Appeals <br /> A <br /> GENERAL FINDINGS <br /> B <br /> 1. that the subject property is located at 110 Degrass Road and consists of 14,109 <br /> square feet. <br /> y SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. the long and narrow shape of the subject lot dictates location of the proposal; <br /> therefore, a literal enforcement of the By-laws would involve hardship to the <br /> Petitioner. <br /> 2. the small nature of relief being requested would have little or no impact on <br /> jthe abutting lots; therefore, relief may be granted without detriment to the <br /> j public good and without derogating from the intent or purpose of the By-laws. <br /> 3. that the subject property is impacted by wetlands. <br /> 4. that the Board determined that without relief the lot could not be used for a <br /> t� I <br /> t - <br /> r; <br /> residence,the purpose for which it had been laid out and for which the <br /> balance of the undersized lots in the subdivision were being used. <br /> ' 5. the subject lot was created in the 1960's and predates Zoning By-laws. <br /> r In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> tS <br /> is <br /> made and seconded,the Zoning Board of Appeals voted unanimously on January 10, <br /> 2001 to grant a Variance of 1.9 feet on the northeasterly corner of the poured foundation <br /> to the property line. The Variance is conditioned upon compliance with plan entitled: <br /> "Plot Plan of Land in Mashpee—Mass.,Prepared for Harbor Homes,Plan No. 1211 OPP, <br /> Date: Dec. 11, 2000, Ferreira Associates". i <br />
